1. Introduction of the platform

 

The conditions

 

These General Terms and Conditions apply to any use of the Indie Campers vehicle rental platform. They also serve to define the conditions of use of the website and the relationships between the website and its users.

 

The Website offers an intermediation service between Users, whereby the Host offers the rental of his vehicle and the Traveler can book a vehicle available on the Website to use it as part of a rental under the conditions agreed between the parties.

 

The Website acts primarily as an intermediary and assistant to users when it is necessary to validate elements and documents in order to advertise the vehicle or make a rental.

 

The host is solely responsible for its advertisements and services. When the traveler makes a reservation, he or she enters into a contract directly with the rental company and not with Indie Campers, which is not a party to the rental agreement or is involved in it in any way.

 

Indie Campers requests Users to read these Terms and Conditions carefully. These are the terms and conditions under which Hosts rent vehicles to Travelers.

 

Users can contact Indie Campers through customer service or by email using the contacts available on the website. However, questions relating to the vehicle or the rental itself should be clarified directly between the users.

 

Should Indie Campers need to contact the user, this will be done by telephone or in writing via email or via the address that the user provided to Indie Campers when registering on the website.

 

2. Introduction of the payment provider

The transactions are carried out by Stripe, which processes the payments in a secure manner. Stripe Technology Europe, Limited (STEL) is authorized by the Electronic Money Institution and regulated by the Bank of Ireland (Reference Number: C187865). The platform only guarantees the security of payments made through the Stripe partner. If users decide to make payments directly to each other, Indie Campers cannot guarantee the security of these payments. .

 

3. Users

 

3.1 Registration of travelers

 

Travelers wishing to make a reservation with Indie Campers must register on the website, providing their personal details and proof of documents. Indie Campers is not liable if the data provided by the user is incorrect. Some documents can only be inserted after the booking confirmation, but never after the date indicated in the rental conditions chapter.

Each user has a unique username and password with which they can directly access their profile. The user undertakes to treat this data confidentially and never to pass it on. The user guarantees that he only creates a single “profile”.

In case of non-compliance with the rules of the Platform or behavior considered abusive by the Platform, Indie Campers reserves the right to suspend the account. The user whose account is blocked will be informed by email to the email address provided during registration. All data and documents must be entered on the website on the traveler's personal page.

 

3.2 Structure of the website

 

The Platform consists of a public area and a private area, accessible in different ways and with different restrictions:

The public area allows access to the website, use of the website as an unidentified user and the use of certain services and functions offered by the website.

The private area is accessible after identification and registration of the user. This identification requires the prior creation of a profile. The private area allows, among other things, to make reservation requests, as well as the subsequent confirmation, the publication of a rental vehicle and the processing of information about the publication of a rental vehicle.


3.3 Registration of Hosts and Vehicles

 

All hosts who wish to post their offers on the platform must create their user profile. In addition, hosts must fill out the form to create a listing in detail.

When creating the publication, the user must provide the requested information and documents in as much detail as possible and attach photos of their vehicle. The operators of the vehicles can be natural or legal persons.

If the Host wishes to take advantage of the insurance offered by the Platform, providing incorrect information about the Vehicle may result in the cancellation of insurance coverage, namely

In addition, certain documents must be presented before a booking is confirmed. The required documents can be viewed on this page.

All of these documents must be constantly updated. Otherwise, the vehicle will no longer be eligible for the insurance offered by the Platform and the ad itself may be suspended until the documents have been communicated and validated by the Platform. The host agrees that the platform will pass on these documents to the insurance partners and to the payment partner STRIPE. The host also undertakes to provide the bank details through which the payments are to be processed.

Following a breakdown or other incident, an advertisement may be placed on the Platform to check whether the vehicle in question is suitable for rental. Indie Campers reserves the right to suspend a vehicle offered for rental if there is a risk that could affect the quality of the service.

Indie Campers carries out a summary check of the information and documentation provided by the rental company, focusing on the elements relating to the characteristics of the vehicle. This verification occurs at the time of registration of the vehicle on the website and does not release the traveler from its verification at the start of the rental. Indie Campers reserves the right to review the documents at any time.

Indie Campers has the right to remove a vehicle listing from the website after a review or following a message from one or more travelers who are dissatisfied with the condition of the vehicle and/or the behavior of the host, as well as due to non-compliance with the applicable terms and conditions.

 

3.4 Requirements Applicable to Hosts

 

The hosts must guarantee:

- have full ownership of the vehicle or be the manager of the vehicle and have all the necessary authorizations and certificates that allow him to make the vehicle available for rental. The Host must provide the Traveler with these authorizations in writing and signed by the Host of the Vehicle;

- that the documents and information communicated are truthful and correct;

- the availability of the vehicle in perfect condition for rental;

- the good condition of the vehicle before departure in terms of interior and exterior cleaning, water and fuel levels, etc.

The Host undertakes to comply with the minimum availability required by the Platform, which can be viewed on the Website.

Likewise, the landlord cannot charge additional costs for the consumption of gas cylinders that are already in use at the beginning of the rental agreement, as this is a consumable that is difficult to measure and must be included in the rental price.

3.5 Relationship between Traveler and Host

 

Users interact with each other through the Indie Campers website and can make inquiries, leave reviews, check vehicle availability, make, accept or cancel reservations.

The host and the traveler must reach an agreement before entering into the rental agreement and before each vehicle rental. Users are contractually obliged and must respect the commitments made since the reservation was confirmed.

A rental agreement for the vehicle must be concluded between the host and the traveler (“Rental Agreement”). When signing the rental agreement, the traveler and the host undertake to comply with the conditions set out therein, in accordance with the principle of "pacta sunt servanda", that is, the principle of the binding nature of contracts, in which the contracting parties are solely responsible for the contract concluded.

The rental company undertakes to provide a current description of the vehicle that corresponds to its characteristics and not to deceive the renter about the characteristics of the rented vehicle. The Platform cannot be held liable in the event of an incorrect or incorrect description of the vehicle.

The landlord undertakes to provide the vehicle documents for every reservation. Depending on the applicable regulations of the country in which the vehicle is registered and the applicable insurance requirements, the host must provide the original or a copy of the vehicle registration document, proof of insurance and proof of a recent technical inspection. A certified copy of the registration certificate can be requested from a police station to increase the credibility of the document in the event of a police check during the rental.

 

3.6 Disputes between users

In the event of any dispute between Users, the Platform will use its best efforts to provide Users with an arbitration service.

 
4. Booking conditions

Subscription product exclusive:

Prices are displayed per month and accessed directly as a total cost per month, without incurring additional costs (e.g. service, insurance or preparation costs), with the exception of one-way costs and mileage regulations. For bookings with a subscription term, a minimum duration of 1 month applies ("Minimum Initial Commitment") and a maximum duration of 12 months.

Short-term rental product exclusive:

The cost of renting the vehicle is charged per night, provided the vehicle that is the subject of the booking is available.

Common to all products available on the platform:

The users freely and by mutual agreement determine the duration of the rental. Rentals start at 2:00 p.m. and end at 11:00 a.m. The platform allows landlords to set the times from which both check-in and check-out are possible only at an additional cost, which will always be communicated to the user in advance before committing to these specific check-ins and Check-out times decide.

The traveler can make a reservation request for a specific vehicle, making sure to specify the dates for which he wants to reserve the vehicle. The traveler is only entitled to start the vehicle rental after confirmation of the reservation and appropriate payment of the total amount of the reservation.

If the landlord accepts the reservation request, which must happen within 48 hours of receiving the reservation request, Indie Campers will inform the traveler by email, who will then have 48 hours to make payment. The amount corresponding to the rent will then be debited. If the landlord refuses to reserve his vehicle, Indie Campers will automatically inform the traveler by email and, depending on availability, will be ready to suggest an equivalent vehicle as an alternative. Indie Campers cannot be held responsible for the rejection of a booking request. Indie Campers is exempt from any responsibility in the event of cancellation of the reservation by the landlord or the traveler and does not guarantee the accuracy of the reservation request data provided by the traveler wishing to rent the vehicle.

The traveler can extend the duration of the rental by requesting a mandatory extension of the reservation. The application must be submitted at least 48 hours before the end of the rental period. Any extension of the rental period is subject to the rules set out in these General Terms and Conditions. The application for an extension must be made via Indie Campers and is subject to subsequent approval by the landlord. The vehicle's insurance must be renewed and an additional payment will be required at the time of confirmation of the change. Any extension of the reservation must be made under the conditions made available on the platform on the same day, i.e. rental price, insurance price, intermediation services, etc.

In the event that the traveler does not make the handover at the specified date, time and place, a charge of three times the value per night including all related costs will be charged per night announced on the Platform, unless the Users can prove that the damage to the platform was significantly less than this amount. For each additional night that has not been agreed by both parties, the Host is entitled to charge three times the equivalent of the price per night announced on the Platform as well as the associated costs, unless the User can prove that the Damage to the platform was significantly less than this amount. In addition, insurance coverage is not guaranteed for additional days not previously reported and agreed upon and the traveler is fully responsible for any damage or costs that would otherwise be covered by insurance. 5. Rental conditions

The traveler making a reservation must be over 18 years of age at the time of registration, have a valid driver's license for the country in which they are checking in and out, be legally authorized to drive the rented vehicle, have a valid ID card and a must be able to present a valid payment card and meet all requirements set by the landlord, such as minimum age and driving experience at the time of the start of the rental. Additional drivers must be present when picking up the vehicle, have a valid driver's license for the country of arrival and departure and for the type of vehicle rented, and meet all requirements set by the rental company, such as minimum age and driving experience at the time of rental start. If these requirements are not met, additional passengers cannot be added as additional drivers of the vehicle.

For short-term rentals where the rental company is Indie Campers, choosing the Basic Protection Plan is mandatory if one of the drivers is under 25 years old, and drivers under 25 years old are not allowed to accept the Premium Protection Plan. Protection plans are not included and cannot be subscribed to by the customer as part of subscription bookings.

Before starting the rental, the traveler is obliged to provide all information and documents requested in his profile on the platform. The traveler must do this up to 48 hours or working days before the start of the rental. Failure to provide the requested information and documents will result in the rental not being carried out if this information is essential for Indie Campers to ensure the identity of the customer and to comply with applicable laws (e.g. tax laws). Documents and information requested may include the following:

● Valid citizen ID or passport

● Valid driving license

● Address of permanent residence

When collecting the vehicle, the rental company or a duly authorized representative must be present during the inventory to check the condition of the vehicle before and after rental by signing the rental agreement.

Indie Campers offers a rental agreement proposal. The rental company is free to use, modify or use another type of contract as long as both parties sign it and it fully describes the vehicle and its features and equipment.

Both parties are obliged to take photographs of the vehicle inside and out upon arrival and departure, as well as to check the odometer and the level of the fuel tank, as this is necessary and essential for the resolution of disputes between users.

In the event that the vehicle offered for rental has main characteristics that do not correspond to those indicated on the platform or is of significantly lower quality, the traveler may withdraw from the contract until the contract is signed and request a refund of the entire booking amount. In the event of a challenge, the traveler must provide evidence (photos, videos, ...) that the reality differs from the information published on the platform. The platform will evaluate the case and make a decision. Cancellation of the booking must be made via the contact options specified in these conditions with the platform.

The renter is obliged to return the vehicle to the landlord at the end of the rental period in a contractually agreed condition at the agreed location and at the agreed return time. If the vehicle is excessively dirty, which requires special cleaning of the vehicle, or if the vehicle is returned with an odor, the renter must pay the rental company compensation. Special cleaning costs are calculated based on effort, but at least with a special cleaning flat rate, unless the tenant proves that the landlord suffered no damage or significantly less damage.

.. The traveler is responsible for ensuring that the vehicle always contains the necessary fuel and AdBlue for circulation during the journey without damaging the engine. Additional AdBlue can be purchased at any gas station in the traveler's name during the rental period. The rental company does not reimburse the traveler for the costs of AdBlue fluid when the vehicle is returned. The rental company is responsible for assessing the condition of the vehicle upon delivery. The costs mentioned in this paragraph can be reduced if the user can prove that the damage to the platform was significantly less than the costs charged by the platform.


6. Payment Terms

 

6.1 Payment by the traveler

The traveler undertakes to pay the entire rental price on the website according to the payment methods proposed in the advertisements.

If the traveler confirms the reservation, his credit or debit card will be charged (including costs) in accordance with the cancellation conditions set by the landlord. If the debit method is rejected, the reservation will be invalid and no rental confirmation will be sent and the traveler must provide another valid payment method.

If the available payment policy allows to split the payment of the total amount of the reservation over several times, the second payment will be automatically charged using the same payment method chosen at the specified time. If the second payment fails, the traveler will be informed and has 2 days to make the payment using another payment method. If it is not possible to debit the second payment by the specified date, the Platform has the right to cancel the reservation applying the agreed cancellation conditions.

Indie Campers is not liable for the exchange rates used by the traveler's bank nor for the banking costs charged by the traveler's bank. The currency used for payment is always the currency of the country where the trip begins.

 

6.2 Payment to the hosts

 

The host's rental price is transferred via STRIPE. The Host's rental price is always determined independently and is calculated from the total amount of the reservation minus the costs charged by the Platform, including applicable taxes, as well as other insurance and additional services purchased by the Traveler directly from the Platform.

Unless expressly agreed otherwise, the host's compensation will be transferred on the second working day after the reservation begins.

The costs for Indie Campers' placement service are borne by the traveler and the host. By using the service, the traveler accepts the amounts set without any conditions or reservations. For more information about when service fees apply and how they are calculated, please visit our Service Charges page. Unless otherwise stated on the Platform, the Service Cost is non-refundable. Indie Campers reserves the right to change the service costs at any time and will inform users before the cost changes take effect. Fee changes will not affect reservations made prior to the effective date of the fee change. If Host does not agree to a change in costs, Host may terminate this Agreement at any time by deleting its listings on the Platform, although Host remains responsible for previously confirmed reservations. Indie Campers reserves the right to suspend or cancel payment to the host in the event of a dispute with the customer.

 

6.3 Insurance

In cases where additional insurance is required for the rental, the costs resulting from the rental of this insurance will be borne in full by the traveler and will be paid cumulatively with the other amounts of the reservation according to the payment modalities. In the event of an extension of the rental agreement, the vehicle's insurance must be extended and an additional payment will be due.

 

6.4 Protection Plan

The purchase of Protection Plans is fully supported by the Traveler in accordance with the payment terms applicable to the relevant reservation


6.5 Deposit

 

The deposit will be blocked from 24 hours before the start of the trip and can only be paid in one of the ways and with the values ​​specified in the advertisement. The vehicle cannot be released to the traveler if the deposit has not been blocked by the host or Indie Campers. Indie Campers will obligatorily block the deposit if one of the insurance policies offered by Indie Campers has been chosen.

 

When returning the vehicle, the landlord or Indie Campers will release the unused portion of the deposit in the same manner as it was collected and the refund can be made up to 30 working days after the return of the vehicle.

 

The deposit is used to cover damage to the vehicle during the rental period that was culpably caused by the traveler, unless the traveler proves that the rental company suffered no damage or significantly less damage. This amount can be used to cover the costs of repairing the vehicle after an accident or multiple accidents and for damage to the vehicle caused by negligence up to the amount of the deductible of the insurance taken out, unless the traveler proves that the rental company has no or significantly less damage occurred. The deposit can also be used to cover culpable damage to the vehicle that is not covered by the insurance taken out and any deficiencies in the rental agreement, such as covering the excess of the chosen mileage allowance, the passage in tolls and SCUTS costs, any Fines or other amounts that the traveler owes the landlord, unless the traveler proves that the landlord suffered no damage or significantly less damage. The administration of the deposit is subject to the signing of the rental agreement and the vehicle inventory document by the parties upon collection or return of the vehicle.

 

7. Cancellation conditions

 

7.1 Withdrawal by the tenant

 

The cancellation conditions will be applied depending on the landlord's choice, according to the different cancellation conditions that you can consult under cancellation conditions.

The occurrence of unforeseen or unavoidable events for which Indie Campers and the Users are not responsible (examples: force majeure, war, natural disasters, pandemics and strikes) does not exempt from the full application of the aforementioned provisions.

 

7.2 Cancellation by the host

 

In the event of cancellation of the reservation by the host, the amount paid by the traveler will be refunded. If the compensation is already in the possession of the host and it is a withdrawal on his part, the host is obliged to refund the amount received in full or Indie Campers may deduct this amount from future reservations. If Indie Campers reasonably expects to issue a refund to a traveler in accordance with any of these policies, Indie Campers may defer payment for that booking until a decision regarding the refund has been made.

 If the Host cancels a booking, the Host will be charged cancellation costs and other consequences, which will be billed directly or deducted from the compensation of subsequent bookings (unless the User can prove that the damage to the Platform is significantly less than this). amount was). 8. Insurance

 

8.1 Taking out insurance

 

When renting a vehicle through the Platform, mandatory vehicle insurance must be taken out, for which the traveler is responsible. The vehicle can be insured by the host, provided that he or she has valid insurance at the time of rental that also covers use by third parties. For the vehicle that does not have insurance for third-party use, the Customer may use insurance offered by the Platform under the conditions described on the Indie Campers Platform.

Indie Campers and the rental company are not liable for any damage or theft of personal items that occur during the rental period and it is recommended not to leave valuable items in the vehicle while the traveler is outside the vehicle.

8.2 Reporting an accident

 

In the event of an accident, the traveler is obliged to report the accident to Indie Campers or the organizer without undue delay. This does not apply if the traveler's health does not permit this.

 

8.3 Compensation in the event of accidents

 

In the event of damage covered by the insurance taken out, any damage caused by the traveler will result in the payment of the excess if the repair amount is higher than the excess set by the insurer, or in the payment of the repair amount if it is lower than the amount of the damage Insurer established excess, except under the conditions of exclusion by the motor insurance in force during the rental, in which all responsibilities and costs will be charged to the traveler.

 

9. Protection of data

 

In accordance with current regulations on the protection of personal data and information society services and electronic commerce, the personal data, both those collected for the conclusion of this contract and those collected during the rental period, will be stored in a personal file for the purpose of the rental of rental vehicles, as well as for commercial purposes, and to inform users by email of any offers, products and promotions that may be of interest.

 

Users have the rights recognized in the General Data Protection Regulation to access, rectify and delete data, object to their processing and request their restriction.

Mietvertrag

1. Fahrzeugbedingungen

1.Der Mietvertrag endet mit dem Ablauf der vereinbarten Mietzeit. Setzt der Mieter den Gebrauch des Fahrzeugs nach Ablauf der vereinbarten Mietzeit fort, so gilt der Mietvertrag nicht als verlängert. § 545 BGB findet keine Anwendung.

2. Der Mieter wird das Fahrzeug in sauberem Zustand, mit der gleichen Menge Kraftstoff bei der Übernahme und mit allen Funktionen des Fahrzeugs in normalem Zustand zu dem im Mietvertrag festgelegten Rückgabetermin, -zeitpunkt und -ort zurückgeben.

2. Dokumente

2.1 Bei der Übergabe des Fahrzeugs muss der Mieter einen Personalausweis oder Reisepass, einen für das Führen des Fahrzeugs erforderlichen und im Land gültigen Führerschein sowie ein mindestens 30 Tage nach Rückgabe des Fahrzeugs gültiges und vom Vermieter akzeptiertes Zahlungsmittel vorlegen.

2.2 Kann der Mieter diese Dokumente bei der Übergabe des Fahrzeugs nicht vorlegen, tritt der Vermieter vom Mietvertrag zurück.

2.3 Bei kurzfristigen Buchungen, wenn einer der Fahrer unter 25 Jahre alt ist, ist der Erwerb des Basisschutzes obligatorisch, da der Mieter bei der Anmietung eines Fahrzeugs nicht berechtigt ist, den Premiumschutz zu erwerben. Der Kunde sichert hiermit zu, dass die dem Vermieter mitgeteilten Dokumente (und alle darin enthaltenen Informationen) wahrheitsgemäß, vollständig und gültig sind, insbesondere in Bezug auf die Adresse und das Land des Wohnsitzes des Kunden.

2.4 Für Abonnementbuchungen: Wenn der steuerliche Wohnsitz des Mieters außerhalb der Europäischen Union (einschließlich der Schweiz und des Vereinigten Königreichs) liegt, kann der Mieter ein Fahrzeug in jedem der Länder und Städte mieten, in denen diese verfügbar sind. Liegt der steuerliche Wohnsitz des Mieters in Irland, Portugal, Spanien, Frankreich, Italien, Deutschland, Belgien, den Niederlanden, Österreich, Kroatien, Schweden und Island, kann der Mieter ein Fahrzeug nur in dem Land anmieten, in dem er seinen Wohnsitz hat. Befindet sich der steuerliche Wohnsitz des Mieters in einem anderen EU-Land als Irland, Portugal, Spanien, Frankreich, Italien, Deutschland, Belgien, den Niederlanden, Österreich, Kroatien, Schweden und Island, ist es nicht möglich, ein Fahrzeug über das Abonnementprodukt zu mieten.

3.Nutzung des Fahrzeugs

3.1 Der Mieter verpflichtet sich, dass das Fahrzeug während der Mietzeit nicht a) von einer Person gefahren wird, die nicht im Mietvertrag als Fahrer angegeben ist. b) unvorsichtig und gefährlich gefahren wird. c) von einer Person gefahren wird, die unter Alkohol- oder Drogeneinfluss steht. d) Mit dem Schlüssel im Fahrzeug zurückgelassen werden, während es unbesetzt ist. e) Durch Eintauchen in Wasser, Kontakt mit Salzwasser, Fahren durch überschwemmte Gebiete, Fahren am Strand und auf unbefestigten Straßen beschädigt werden. f) Für Rennen, Wettbewerbe oder illegale Aktivitäten verwendet werden. g) Zum Abschleppen von Fahrzeugen verwendet werden. h) Zur Beförderung von Passagieren oder Eigentum gegen Entgelt verwendet werden. i) Zur Beförderung einer Anzahl von Personen, die die gesetzlich zulässige Höchstkapazität übersteigt. j) Zur Beförderung von Gefahrenstoffen, flüchtigen Flüssigkeiten, Gasen, Sprengstoffen oder anderen ätzenden oder brennbaren Stoffen, mit Ausnahme des vom Vermieter zur Verfügung gestellten Gases. k) Zur Beförderung und zum Transport von Gütern, die über das hinausgehen, was bei einer Freizeitvermietung vernünftigerweise erwartet werden kann. l) Zur Anbringung von Zubehör und Werbung oder kommerziellen Hinweisen. m) Zum Fahren im Gelände, auf gesperrten Straßen oder auf Straßen, die nach den örtlichen Gesetzen und Vorschriften nicht für das gemietete Fahrzeug geeignet sind.

3.2. Der Vermieter haftet weder für die Folgen noch für Schäden, Verluste und/oder sonstige Kosten, die sich daraus ergeben, dass der Mieter nicht in Übereinstimmung mit den vorgenannten Punkten (a) bis (l) handelt.

3.3 Der Mieter erkennt an, dass der Vermieter zu jeder Zeit Eigentümer des Fahrzeugs ist und darf nicht vereinbaren, versuchen, anbieten oder vorgeben, das Fahrzeug an eine andere Partei zu verkaufen, unterzuvermieten, zu verleihen oder zu verpfänden.

3.4 Der Mieter darf ohne vorherige schriftliche Zustimmung des Vermieters keine Änderungen oder Ergänzungen am Fahrzeug vornehmen.

3.5 Der Mieter unternimmt alle angemessenen Schritte zur ordnungsgemäßen Wartung des Fahrzeugs, einschließlich der täglichen Überprüfung von Öl, Wasser und Batterien, und kontaktiert den Vermieter, wenn Warnleuchten des Fahrzeugs eine mögliche Fehlfunktion anzeigen.

3.6 Alle elektrischen Geräte (einschließlich der Kühlbox) dürfen nicht länger als 4 Stunden am Stück an die Batterie angeschlossen werden, ohne dass die Fahrzeugbatterie täglich auf Campingplätzen oder an anderen 220V-Quellen aufgeladen wird.

3.7 Der Mieter ist dafür verantwortlich, die Wettervorhersagen und die Straßenverhältnisse auf seinen Reisen zu verfolgen und sich darüber zu informieren, sowie die öffentliche Warnung darüber.

3.8 Der vorliegende Mietvertrag wird sofort gekündigt und die Buchung wird storniert, ohne dass ein gerichtliches Eingreifen erforderlich ist, wenn das Fahrzeug in einer Weise genutzt wird, die eine Verletzung des vorliegenden Mietvertrags oder die Begehung einer Straftat darstellt. Darüber hinaus behält sich der Vermieter das Recht vor, das Fahrzeug jederzeit und ohne Vorankündigung zurückzufordern, wobei der Mieter für alle anfallenden Kosten verantwortlich ist.

3.9 Der Mieter darf das Fahrzeug in keinem Fall ohne vorherige schriftliche Zustimmung des Vermieters untervermieten oder abtreten.

4. Haustiere

Es ist erlaubt mit einem Haustier, welches nicht mehr als 30kg wiegt, zu reisen. In solch einem Falle berechnen wir eine Gebühr (Reinigung nach der Reise). Die Reinigung nach der Reise deckt lediglich die Reinigung nach der Miete ab. Der Mieter ist verantwortlich für jegliche Schäden im inneren und äusseren des Fahrzeuges, welche vom Haustier verursacht wurden. Es ist die volle Verantwortung des Mieters sicherzustellen, dass das Haustier unter sicheren Bedingungen und entsprechend der örtlichen Vorschriften reist. Der Vermieter übernimmt keine Haftung für Strafzettel oder Rechtskosten im Zusammenhang mit der Mitnahme des Haustieres im Fahrzeug.

5. Gaspolitik

5.1 Modelle mit tragbaren Kochern: Kunden, die im Voraus für Gas bezahlt haben, erhalten 2 volle Einweg-Gaskanister (220 g). Zusätzliche Gaskanister können während des Mietzeitraums auf Kosten des Mieters erworben werden.

5.2 Modelle mit eingebautem Kocher/Herd: Der Vermieter liefert das Fahrzeug mit zwei Gasflaschen, nämlich der vom Vormieter zurückgegebenen Flasche (mit variablem Gasstand) und einer vollen versiegelten Flasche Campinggas. Der Mieter hat die Möglichkeit, die versiegelte Flasche während der Fahrt zu benutzen, und wenn er dies tut, wird der Vermieter dem Mieter den festgelegten Preis in Rechnung stellen

5.3 Zusätzliche Gasflaschen oder Nachfüllungen können während des Mietzeitraums auf Kosten des Mieters erworben werden.

5.4 In verschiedenen Ländern gibt es unterschiedliche Anschlüsse und Gasflaschen, so dass zum Nachfüllen möglicherweise ein Adapter erforderlich ist. Bitte beachten Sie, dass die mitgelieferten Gasflaschen nicht gegen ausländische Flaschen ausgetauscht werden dürfen.

6. AdBlue-Politik

6.1 AdBlue ist eine Dieselabgasflüssigkeit, die in modernen Fahrzeugen mit Dieselmotoren benötigt wird. Alle Modelle, die AdBlue benötigen, sind mit einem AdBlue-Tank gekennzeichnet, der sich neben dem Kraftstofftank befindet. Ähnlich wie der Kraftstoffstand zeigt das Armaturenbrett des Fahrzeugs an, wenn der AdBlue-Stand niedrig ist.

6.2 Das Fahrzeug wird oberhalb des AdBlue-Mindeststandes für den Verkehr abgegeben (ohne AdBlue-Leuchten) und muss in diesem Zustand zurückgegeben werden, andernfalls werden Betankungsgkosten fällig

6.3 Während der Fahrt ist der Mieter dafür verantwortlich, dass das Fahrzeug immer über den erforderlichen Kraftstoff und AdBlue verfügt, ohne den Motor zu beschädigen.

6.4 Zusätzliches AdBlue kann während des Mietzeitraums an jeder Tankstelle auf Kosten des Mieters gekauft werden. Der Vermieter erstattet dem Mieter bei Rückgabe des Fahrzeugs keine Kosten für AdBlue-Flüssigkeit.

7. Kilometerstandspolitik

7.1 Alle Buchungen beinhalten eine feste Anzahl von Kilometern/Meilen pro Nacht, die je nach Saison und Anzahl der Nächte variieren kann.

7.1.2) Kunden haben die Möglichkeit, vor ihrer Reise während des Buchungsvorgangs zusätzliche km/Meilen-Pakete oder unbegrenzte km/Meilen hinzuzufügen.

7.1.3) Alle zusätzlichen km/Meilen werden bei der Rückgabe berechnet. Der Wert der Gebühr pro zusätzlichem km/Meile für jede Buchung wird während des Buchungsprozesses mitgeteilt, da er je nach Abholort und Fahrzeugmodell variieren kann.

7.2 Bei Buchungen im Rahmen eines Abonnements beträgt die Anzahl der kostenlosen Inklusivkilometer 1.000 km pro Monat oder 10.000 km pro Jahr. Gegen einen Aufpreis können monatliche Pakete von plus 500km/Monat und plus 1.000km/Monat zur Buchung hinzugefügt werden. Wenn die Buchung eine Dauer von einem Jahr hat, können zusätzlich Jahrespakete von plus 6.000km/Jahr, plus 12.000km und plus 18.000km gebucht werden. Überschreitet der Kunde die Grenzen von 1.000 km pro Monat oder 10.000 km/Jahr, ohne monatliche/jährliche Zusatzkilometerpakete zu buchen, oder wurden diese ebenfalls überschritten, erhebt der Vermieter eine zusätzliche Gebühr für jeden Kilometer, der die genannten Grenzen überschreitet. Der Wert der Gebühr pro zusätzlichem km/Kilometer für jedes Abonnement wird während des Buchungsvorgangs mitgeteilt, da er je nach Abholort und Fahrzeugmodell variieren kann.

7.3 Volkswagen ID Buzz Mietbedingungen - Batteriestand und Ladepolitik

7.3.1. Einleitung: Diese Bedingungen gelten für die Anmietung des Volkswagen ID Buzz in Europa. Mit der Anmietung dieses Fahrzeugs verpflichten Sie sich, diese Bedingungen einzuhalten, insbesondere was den Batteriestand zum Zeitpunkt der Rückgabe des Fahrzeugs betrifft.

7.3.2. Erforderlicher Batteriestand bei Rückgabe

a. Minimaler Batteriestand: Das Fahrzeug muss mit einem Batteriestand zurückgegeben werden, der nicht mehr als 10 Prozentpunkte unter dem Stand liegt, mit dem es ausgeliefert wurde. Damit soll sichergestellt werden, dass das Fahrzeug für die nachfolgenden Nutzer einsatzfähig bleibt und der Zustand der Fahrzeugbatterie erhalten wird.

b. Bewertung des Batteriestands: Bei Rückgabe des Fahrzeugs wird der Batteriestand von unseren Mitarbeitern überprüft. Liegt der Batteriestand um mehr als 10 Prozentpunkte unter dem Auslieferungszustand, werden zusätzliche Gebühren fällig.

7.3.3. Kosten für die Aufladung bei Batteriedefizit

a. Kostenberechnung: Wenn der Batteriestand zum Zeitpunkt der Rückgabe nicht der geforderten Norm entspricht, wird dem Kunden die fehlende Energie in Rechnung gestellt, um den Batteriestand auf 10 Prozentpunkte unter dem gelieferten Stand zu bringen.

b. Preisgestaltung: Die Kosten für die fehlende Energie werden auf der Grundlage des aktuellen Preises pro Kilowatt (0,3782 € pro KW) berechnet.

7.3.4. Ein Ladezuschlag von 100 € wird erhoben, wenn das Fahrzeug mit einem Batteriestand von weniger als 25 % zurückgegeben wird.

8. Pannenhilfe und technische Fragen

8.1 Nach einem Unfall, Diebstahl, Brand, Wild- oder sonstigen Schaden hat der Mieter bzw. Fahrer unverzüglich die Polizei zu verständigen und hinzuzuziehen; insbesondere ist der Schaden bei der nächsten Polizeidienststelle anzuzeigen, wenn die Polizei telefonisch nicht erreichbar ist. Dies gilt auch, wenn das gemietete Fahrzeug leicht beschädigt wurde, sowie bei selbstverschuldeten Unfällen ohne Beteiligung Dritter.

8.2 Bei Beschädigung des Fahrzeugs während der Mietzeit ist der Mieter verpflichtet, den Vermieter unverzüglich schriftlich über alle Einzelheiten des Ereignisses, das zu der Beschädigung des Fahrzeugs geführt hat, zu informieren. Dies gilt auch im Falle des Diebstahls des Fahrzeugs oder von Fahrzeugteilen. Zu diesem Zweck hat der Mieter das bei den Fahrzeugpapieren befindliche Formular für einen Unfallbericht sorgfältig und wahrheitsgemäß auszufüllen, insbesondere Ort, Zeit, Beschreibung des Unfallgeschehens, vollständiger Name und Anschrift des Fahrers zum Unfallereignis. Darüber hinaus kann das Formular jederzeit beim Vermieter telefonisch angefordert oder auf den Internetseiten des Vermieters abgerufen werden.

8.3 Der Mieter bzw. Fahrer hat alle Maßnahmen zu treffen, die der Aufklärung des Schadensereignisses dienlich und förderlich sind. Dazu gehört insbesondere, dass er die Fragen des Vermieters nach den Umständen des Schadensereignisses wahrheitsgemäß und vollständig beantworten muss und den Unfallort nicht verlassen darf, bevor die notwendigen und insbesondere für den Vermieter zur Beurteilung des Schadensereignisses wichtigen Feststellungen getroffen werden konnten oder ohne dem Vermieter diese zu ermöglichen.

8.4 Die Verpflichtungen gemäß Ziffer 8. 1)-3) gelten nur, soweit der Gesundheitszustand und die körperliche Unversehrtheit des Mieters oder Fahrers es zulassen oder der Gesundheitszustand und die körperliche Unversehrtheit nicht gefährdet sind.

8.5 Die Hilfeleistung des Vermieters erstreckt sich auf jede technische oder mechanische Störung des Fahrzeugs, die auf einen Fabrikations- oder Materialfehler zurückzuführen ist, der das betreffende Teil während der Gewährleistungsfrist unmittelbar betriebsunfähig macht.

8.6 Folgende Ereignisse sind von der Leistung des Vermieters ausgeschlossen: a) Kraftstoffmangel des Fahrzeugs. b) Entladene Batterien durch unsachgemäßen Gebrauch und/oder unsachgemäßen Gebrauch von Geräten, für deren Betrieb Batterien erforderlich sind. c) Blockieren des Fahrzeugs im Gelände oder auf einer unbefestigten Straße. d) Eine Panne, die durch vorsätzliche Fahrlässigkeit (z.B. Fahren im Gelände) verursacht wurde.

8.7 Der Vermieter bietet einen 24-Stunden-Assistenzdienst an, obwohl es außerhalb der üblichen Geschäftszeiten zu Verzögerungen kommen kann. Wird während der Mietzeit eine Reparatur des Kilometerzählers oder eine Reparatur zur Aufrechterhaltung der Betriebs- oder Verkehrssicherheit des Fahrzeugs oder eine vorgeschriebene Inspektion notwendig, kann der Mieter eine Vertragswerkstatt bis zu einem voraussichtlichen Reparaturpreis von 100 EUR netto beauftragen. Im Falle von Abonnementmieten muss der Mieter, wenn während der Abonnementdauer eine vorgeschriebene Inspektion erforderlich ist, an einem bestimmten, von Indie Campers anzugebenden Ort erscheinen. Im Falle eines Unfalls, den der Mieter zu verantworten hat, ist der Vermieter nicht verpflichtet, ein Ersatzfahrzeug zu stellen. 7) Bei Stillstand des Fahrzeugs aufgrund einer mechanischen Panne oder eines Unfalls und wenn eine Reparatur vor Ort nicht möglich ist, schickt der Vermieter einen Abschleppwagen, der das Fahrzeug und den Mieter zur nächstgelegenen Werkstatt oder Vermietstation fährt.

9. Versicherungsschutz

9.1 Das Mietfahrzeug ist gegen Haftpflicht- und Sachschäden versichert. 2) Die Versicherung ist in den folgenden 32 europäischen Ländern gültig: Andorra, Belgien, Bulgarien, Dänemark, Deutschland, Estland, Finnland, Frankreich, Griechenland, Großbritannien, Irland, Island, Italien, Kroatien, Lettland, Litauen, Luxemburg, Malta, Niederlande, Norwegen, Österreich, Polen, Portugal, Rumänien, Schweden, Schweiz, Slowakei, Slowenien, Spanien, Tschechische Republik, Ungarn und Zypern. Die Fahrzeuge dürfen nur in diesen Ländern gefahren werden, und das Fahren in anderen als den oben genannten Ländern ist nicht gestattet. .

9.2 Der Versicherungsschutz für das gemietete Fahrzeug erstreckt sich auf eine Haftpflichtversicherung mit einer maximalen Deckungssumme für Personen- und Sachschäden von 100 Mio. EUR. Die maximale Deckungssumme pro geschädigter Person beträgt 8 Mio. EUR. EUR und ist auf Europa beschränkt.

9.3 Alle Protection-Pläne beinhalten Roadside Assistance (die 24/7 Line Assistance und das Abschleppen eines Indie Campers Fahrzeugs zu einem nahegelegenen Indie Campers Depot oder einer Autowerkstatt im Falle eines Unfalls oder einer mechanischen Panne).

9.4 Wenn die Fensterabdeckung gewählt wird, sind die Reparaturkosten für ein Glasfenster abgedeckt. Scheinwerfer, Seitenspiegel und Dachfenster (Oberlichter) sind nicht eingeschlossen.

9.5 Bei Auswahl der Reifendeckung ist die unfallbedingte Beschädigung eines Reifens abgedeckt. Die Felge und der Service zum Wechseln des Reifens sind nicht eingeschlossen.

9.6 Schutzpläne sind nicht inbegriffen und können vom Kunden im Rahmen der Abonnementbuchungen nicht abonniert werden. Auf der anderen Seite, i) Pannenhilfe wird unter den gleichen Bedingungen der kurzfristigen Buchungen zur Verfügung gestellt werden, ii) der Vermieter wird die Wartung Reifen (nur für die Nutzung, nicht Schäden) und Ölwechsel.

9.7 Bei Schäden im Rahmen der Abonnementbuchungen, die auf das Verschulden des Kunden zurückzuführen sind, wird dem Kunden ein neues Fahrzeug zur Verfügung gestellt, sobald der Vermieter für diese Schäden entschädigt wurde.

9.8 Im Falle einer Fehlfunktion des Fahrzeugs im Rahmen der Abonnementbuchungen, die auf ein Verschulden des Vermieters zurückzuführen ist, wird dem Kunden ein neues Fahrzeug zur Verfügung gestellt, sobald der Vorfall vom Vermieter analysiert wurde.

11. Haftung

Die Parteien haften nach den geltenden gesetzlichen Bestimmungen.

12. Rückgabe des Fahrzeugs

12.1 Der Mietvertrag endet mit dem Ablauf der vereinbarten Mietzeit. Setzt der Mieter den Gebrauch des Fahrzeugs nach Ablauf der vereinbarten Mietzeit fort, so gilt das Mietverhältnis nicht als verlängert. § 545 BGB findet keine Anwendung.

12.2 Der Mieter ist verpflichtet, das Fahrzeug nach Ablauf der Mietzeit in vertragsgemäßem Zustand am vereinbarten Ort und zur vereinbarten Rückgabezeit an den Vermieter zurückzugeben. Sonderreinigungskosten werden nach Aufwand, mindestens jedoch mit einer Sonderreinigungspauschale berechnet, es sei denn, der Mieter weist nach, dass dem Vermieter kein oder ein wesentlich geringerer Schaden entstanden ist.

13. Haftung / Kaution und nachträgliche Zahlungen

13.1 Die Kaution kann nur per Kreditkarte/Debitkarte (Visa, AMEX oder Mastercard) bezahlt werden, und der Inhaber der Kreditkarte/Debitkarte muss bei der Abholung anwesend sein. Es werden nur Debitkarten akzeptiert, mit denen eine Kaution hinterlegt werden kann. Unter keinen Umständen werden wir akzeptieren, dass eine Einzahlung als Transaktion mit einer beliebigen Kartenart belastet wird. Wir empfehlen Ihnen, sich bei Ihrer Bank zu erkundigen, ob Ihre Debitkarte eine Einzahlung mit Sperrfrist zulässt. Bei der Fahrzeugübergabe ist der Mieter verpflichtet, die Kaution entsprechend der gewählten Schutzplanoption zu hinterlegen. Dieser Betrag wird bis zur Rückgabe des Fahrzeugs auf der Kreditkarte/Debitkarte des Mieters hinterlegt.

13.2 Die Kaution wird dem Mieter am Ende der Mietzeit von einem Mitarbeiter des Vermieters zurückerstattet, der feststellt.

13.3 Der Mieter erklärt sich damit einverstanden, dass der Vermieter berechtigt ist, die hinterlegte Kreditkarte/Debitkarte mit allen weiteren Beträgen zu belasten, die entstehen können, wie z.B. Strafzettel, Bußgelder, Bußgelder für Verkehrsverstöße, Mautkosten, Schäden am Fahrzeug (innen oder außen) und überfällige Beträge, für die der Mieter die alleinige Verantwortung trägt. Der Vermieter ist berechtigt, alle Schäden am Fahrzeug 30 Tage lang nach dem letzten Tag des Mietvertrags zu überprüfen.

13.4 Der Mieter ist verpflichtet, dem Vermieter eine alternative Kreditkarte/Debitkarte zur Verfügung zu stellen, die zur Erfüllung der Verpflichtungen des Mieters aus den Mietbedingungen im Falle unzureichender Deckung, abgelehnter Transaktionen aus irgendeinem Grund und gekündigter oder gesperrter Kreditkarte/Debitkarte verwendet werden kann.

13.5 Die EU-Kommission hat eine Internetplattform zur Online-Streitbeilegung eingerichtet. Die Plattform dient als Anlaufstelle für die außergerichtliche Beilegung von Streitigkeiten über vertragliche Verpflichtungen aus Online-Kaufverträgen. Weitere Informationen finden Sie unter folgendem Link: http://ec.europa.eu/consumers/odr. Wir sind weder bereit noch verpflichtet, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.

13.6 Bei Abo-Buchungen wird bei Abholung eine Kaution einbehalten. Die Höhe der Kaution beträgt 2.500€ (Anzahlung). Zu diesem Zweck wird eine monatliche Bankermächtigung eingeholt. Im Rahmen von Abonnementbuchungen ist nur ein zusätzlicher Fahrer erlaubt.

17. Stornierungsbedingungen - Indie Fleet Flexible Stornierungsbedingungen

Indie Fleet Flexible Cancellation Policy - Gültig ab: 29.01.2024

Diese Stornierungsrichtlinie ("Richtlinie") regelt die Stornierungs- und Rückerstattungsverfahren für Reservierungen, die mit der Mietflotte der Indie Campers Group ("Unternehmen") in allen Ländern und an allen Standorten, an denen die Gruppe tätig ist, vorgenommen wurden. Mit der Reservierung bei der Gesellschaft erklärt sich der Reisende bereit, die in diesem Artikel dargelegten Bedingungen einzuhalten.

17.1. Anwendbarkeit: Diese Richtlinie gilt für alle Reservierungen, die nach der Einführung der flexiblen Stornierungsrichtlinie von Indie Fleet ab dem 29. Januar 2024 vorgenommen werden. Für bestehende Reservierungen, die bis zum 28. Januar 2024 getätigt wurden, gelten weiterhin die Stornierungs- und Rückerstattungsbedingungen der "Indie Fleet Super Flexible Cancellation Policy", beschrieben in Ziffer 17.7

17.2 Bedingungen der flexiblen Stornierungspolitik von Indie Fleet:

17.2.1 Erste Stufe: Stornierung mehr als 30 Tage vor dem geplanten Abholtermin:

Bei einer Stornierung mehr als 30 Tage vor dem geplanten Abholtermin hat der Reisende Anspruch auf eine vollständige Erstattung des bis zu diesem Zeitpunkt gezahlten Gesamtbetrags, berechnet auf der Grundlage des bestehenden Buchungswerts.

Wenn der Reisende in dieser Phase zusätzliche Leistungen oder Tage hinzufügt, ist der volle Betrag für den erhöhten Buchungswert sofort zu zahlen.

Der Reisende versteht auch, dass, wenn der Reisende bereits einen Teil der Buchung bezahlt hat, der Reisende 30 Tage vor dem Abholdatum um eine zweite Zahlung gebeten wird, um die Konten dieser Buchung zu schließen.

Wenn die zweite Zahlung fehlschlägt, wird die Buchung nach 3 Tagen erfolgloser Versuche automatisch storniert. Bitte beachten Sie, dass der Reisende keinen Anspruch auf eine Rückerstattung hat, wenn der gesamte Buchungswert zum Zeitpunkt des zweiten fehlgeschlagenen Zahlungsversuchs noch nicht bezahlt wurde, und der Kunde nicht als in der zweiten Phase befindlich betrachtet wird.

17.2.2 Zweite Stufe: Stornierung zwischen 30 und 8 Tagen vor dem geplanten Abholtermin:

Reservierungen, die weniger als 30 Tage vor dem Abholdatum getätigt werden, müssen zu 100 % mit der ersten Zahlung beglichen werden. Wird die Reservierung zwischen 30 und 8 Tagen vor dem geplanten Abholdatum storniert, hat der Reisende Anspruch auf eine Rückerstattung von 50 % des bis zu diesem Datum gezahlten Gesamtbetrags, berechnet auf der Grundlage des bestehenden Buchungswerts, der den Wert aller in diesem Zeitraum hinzugefügten oder untervergebenen Leistungen einschließt.

17.2.3 Dritte Stufe: Stornierung zwischen 7 und 1 Tag vor dem geplanten Abholtermin:

Bei Stornierungen, die zwischen 7 und 1 Tag vor dem geplanten Abholdatum erfolgen, wird eine Rückerstattung von 5 % des bis zu diesem Datum gezahlten Gesamtbetrags gewährt, berechnet auf der Grundlage des bestehenden Buchungswerts.

17.2.4 Vierte Stufe: Annullierung am selben Tag:

Bei einer Stornierung am Tag der geplanten Abholung hat der Reisende keinen Anspruch auf Erstattung.

17.3. Überlegungen zur Zahlung und Erstattung:

Die Stornierungsbedingungen sind in die flexiblen Zahlungsoptionen integriert, die Indie Campers den Reisenden bei der Buchung eines Roadtrips anbietet. Die Stornierungsrichtlinien der Indie Campers Gruppe sind so konzipiert, dass sie sich nahtlos in unsere flexiblen Zahlungsoptionen integrieren und so eine problemlose Erfahrung für Reisende gewährleisten, die einen Roadtrip mit Indie Campers reservieren. Bei der Erstellung einer Reservierung, die mit der flexiblen Stornierung von Indie Fleet verbunden ist, haben die Reisenden das Recht, ihre Zahlungen zu paketieren. Die erste Zahlung beläuft sich auf 50 % des Buchungswerts, während der Restbetrag durch eine zweite Zahlung beglichen werden kann, die 30 Tage vor dem Abholdatum fällig wird. Alternativ kann der Reisende auch den gesamten Buchungsbetrag zum Zeitpunkt der Reservierung bezahlen. Bitte beachten Sie, dass bei allen Reservierungen, die im Rahmen der flexiblen Stornierung von Indie Fleet innerhalb von 30 Tagen vor dem gewählten Abholdatum vorgenommen werden, der gesamte Buchungswert bei der Reservierung zu zahlen ist. Bei Reservierungen, die mit einer Teilzahlung vorgenommen werden, ist der Abschluss der zweiten Zahlung unerlässlich, um die Gültigkeit der Reservierung zu gewährleisten. Wird die zweite Zahlung nicht geleistet, führt dies zur automatischen Stornierung der Reservierung, ohne dass ein Anspruch auf Rückerstattung besteht. Werden der Reservierung zusätzliche Leistungen hinzugefügt oder Änderungen vorgenommen, die den Buchungswert erhöhen, muss die entsprechende zusätzliche Zahlung sofort nach Aufforderung geleistet werden. Dadurch wird sichergestellt, dass die angeforderten Leistungen tatsächlich in die Reservierung aufgenommen werden. Werden dagegen zusätzliche Leistungen hinzugefügt oder Änderungen vorgenommen, die zu einem geringeren Buchungswert führen, wird der erstattungsfähige Betrag im Falle einer Stornierung innerhalb von 30 Tagen und 1 Tag vor dem Abholtermin anteilig angepasst. Wenn der Reisende Anspruch auf eine Rückerstattung hat, überweist Indie Campers die Beträge innerhalb von 5-10 Werktagen auf das Konto des Reisenden.

Diese neue Widerrufsbelehrung gilt ausschließlich für Reservierungen, die von der Indie Campers Flotte vorgenommen werden. Reservierungen, an denen Fahrzeuge von Drittanbietern beteiligt sind, unterliegen zu diesem Zeitpunkt keinen Änderungen ihrer bestehenden Stornierungsbedingungen

17.5 Schritte der Erstattungsberechnung erklärt.

Im Rahmen unseres Engagements, unseren geschätzten Reisenden ein nahtloses und flexibles Erlebnis zu bieten, haben wir eine Richtlinie zur Berechnung der Rückerstattung eingeführt, die für Reservierungsänderungen und Stornierungen gilt.

Erhöhter Buchungswert: Wenn zusätzliche Leistungen oder Tage zu Ihrer Buchung hinzugefügt werden, was zu einem erhöhten Buchungswert führt, müssen die Reisenden den vollen Betrag für die zusätzlichen Kosten sofort bezahlen, wenn sie unser Customer Experience Team kontaktieren. Durch diesen Schritt wird die Gültigkeit der Reservierung sichergestellt.

Stornierung vor 30 Tagen: Sollte ein Reisender beschließen, seine Buchung vor Ablauf der 30-Tage-Frist zu stornieren, hat er Anspruch auf Rückerstattung des bis dahin gezahlten Betrags, ausgenommen etwaige Bearbeitungsgebühren.

Nichteinhaltung der zweiten Zahlung: Sollte die zweite Zahlung trotz aller Versuche nicht erfolgen, verfällt der im Voraus gezahlte Betrag und es erfolgt keine Rückerstattung. Folglich wird die Buchung storniert.

Stornierung nach der zweiten Zahlung: Wenn ein Reisender die zweite Zahlung geleistet hat und später beschließt, die Reservierung zu stornieren, wird der Rückerstattungsbetrag auf der Grundlage der Bedingungen der Stornierungsbedingungen festgelegt.

Verminderter Buchungswert: Sollten Extras oder Tage von der Buchung gestrichen werden, was zu einem verringerten Buchungswert führt, wird das Unternehmen keine Erstattung für diese Änderungen vornehmen.

Rückerstattungsbearbeitungsgebühr: In bestimmten Fällen kann eine Bearbeitungsgebühr erhoben werden, um die Verwaltungskosten zu decken. Die Höhe dieser Gebühr wird zum Zeitpunkt der Stornierung deutlich angegeben.

17.6 Änderungen der Richtlinie Bitte beachten Sie, dass diese Richtlinie nach dem Ermessen des Unternehmens geändert werden kann. Es liegt in der Verantwortung des Reisenden, die aktuellste Version dieser Richtlinie auf unserer Website einzusehen oder unseren Kundenservice zu kontaktieren, um eventuelle Aktualisierungen zu erfahren. 17.7 Indie Fleet Super Flexible Stornobedingungen - Gültig für Buchungen bis 28/01/2024 Die Flotte von Indie Campers wendet die Super Flexible Stornierungsbedingungen auf alle Buchungen an: Super Flexible Stornierungsbedingungen: Der Mieter erklärt sich damit einverstanden, dass er im Falle einer Stornierung der Reservierung 17 oder mehr Tage vor dem geplanten Abholdatum den gesamten Betrag, den Sie bis zu diesem Datum bezahlt haben, zurückerstattet bekommt. Bitte beachten Sie, dass beide Optionen nur dann zur Verfügung stehen, wenn der Reisende bereits den vollen Buchungsbetrag bezahlt hat. Der Mieter erklärt sich damit einverstanden, dass bei einer Stornierung der Buchung weniger als 17 Tage und mehr als 72 Stunden vor dem geplanten Anreisedatum dem Reisenden 50 % des Buchungswerts zurückerstattet werden, oder der Reisende erhält einen Gutschein in Höhe des vollen Buchungswerts abzüglich einer Stornierungsgebühr (15 % des Buchungswerts) zurück. Bei Stornierungen innerhalb von 72 Stunden vor dem geplanten Check-in-Datum haben Sie keinen Anspruch auf eine Erstattung oder einen Reisegutschein. Erstattung von Gutscheinen: Ab dem Zeitpunkt der Einführung der neuen flexiblen Stornierungspolitik wird die Möglichkeit, eine Erstattung in Form eines "Gutscheins" zu erhalten, für neue Reservierungen, die dieser Politik zugeordnet sind, nicht mehr zur Verfügung stehen.

17.8 Teilweise rückzahlbare Stornierungsbedingungen

17.8.1 Kunden haben Anspruch auf eine Erstattung von 5 % des Buchungsbetrags, wenn die Stornierung mehr als einen Tag vor dem geplanten Abholtermin erfolgt. Für Stornierungen, die am selben Tag wie der Abholtermin erfolgen, gibt es keine Erstattung.

17.8.2. Zahlungsoptionen für die Reservierung

Schritt 1: Stornierung mehr als 30 Tage vor dem geplanten Abholtermin:

Bei Buchungen, die mehr als 30 Tage vor dem Abholdatum getätigt werden, ist zum Zeitpunkt der Buchung eine Zahlung von 50 % des gesamten Buchungsbetrags erforderlich. Die restlichen 50 % werden 30 Tage vor dem Abholdatum in Rechnung gestellt.

Wenn die zweite Zahlung fehlschlägt, wird die Buchung nach 3 Tagen erfolgloser Versuche automatisch storniert. Bitte beachten Sie, dass der Reisende keinen Anspruch auf eine Rückerstattung hat, wenn der gesamte Buchungswert zum Zeitpunkt des Scheiterns der zweiten Zahlung noch nicht bezahlt wurde, und der Kunde wird nicht für Stufe 2 berücksichtigt.

Wird die Buchung mehr als 30 Tage vor dem geplanten Abholtermin storniert, hat der Reisende Anspruch auf Erstattung des vollen Wertes (100 %) der bis zu diesem Zeitpunkt bezahlten Buchung.

Zweiter Schritt: Stornierung zwischen 30 und 8 Tagen vor dem geplanten Abholtermin:

Buchungen, die weniger als 30 Tage vor dem Abholdatum erfolgen, müssen zu 100 % in der ersten Rate bezahlt werden.

Wird die Buchung zwischen 30 und 8 Tagen vor dem geplanten Abholtermin storniert, hat der Reisende Anspruch auf eine Rückerstattung von 50 % des bis zu diesem Zeitpunkt gezahlten Gesamtbetrags, berechnet auf der Grundlage des bestehenden Buchungswerts, der den Wert aller in diesem Zeitraum hinzugefügten oder untervergebenen Leistungen einschließt.

Dritte Stufe: Stornierung zwischen 7 und 1 Tag vor dem geplanten Abholtermin:

Bei einer Stornierung zwischen 7 und 1 Tag vor dem geplanten Abholtermin wird eine Rückerstattung von 5 % des bis dahin gezahlten Gesamtbetrags gewährt, die auf der Grundlage des bestehenden Buchungswerts berechnet wird.

17.8.3. Spezifisch-städtische Stornierungsrichtlinien

Städte der Gruppe A (Lissabon, Madrid, Neapel, Dublin, Köln, Amsterdam, Marseille, Oslo, Anchorage, San Francisco, Orlando): Für alle Buchungen in diesen Städten ist eine Vorauszahlung von 100 % erforderlich, unabhängig von den Stornierungsbedingungen.

Städte der Gruppe B (Barcelona, Rom FCO, Catania, Stuttgart, Paris Charles de Gaulle, Stockholm, Bergen, Denver, Chicago, Auckland, Melbourne): Für alle Buchungen in diesen Städten gelten beide Policen, wobei die Teilerstattungspolice eine obligatorische Vorauszahlung von 100 % erfordert. Bei der flexiblen Police gelten die Standard-Zahlungsoptionen wie beschrieben.

Gruppe C (Bilbao, Florenz, Olbia, Edinburgh, Hamburg, Brüssel Zaventem, Toulouse, Genf, Helsinki, Seattle, New York, Miami, Brisbane): Diese Städte wenden die Teilerstattungsrichtlinie und die flexible Richtlinie mit Standardzahlungsoptionen an, wie in Abschnitt 17.1 beschrieben.

Andere Städte: Für Städte, die nicht zu den Gruppen A, B oder C gehören, gilt standardmäßig die in Artikel 17.1 beschriebene flexible Police, die kostenlos angeboten wird.

17.8.4 Flexible Preisgestaltung für Policen

Der Preis für die Flexible Police richtet sich nach der Nähe des Buchungsdatums zum Abholdatum, wobei die Police günstiger wird, je näher das Abholdatum rückt.

Terms & Conditions for Vehicle Reservation and Future Purchase in Europe

1. SCOPE

1.1. These Terms & Conditions for Vehicle Reservation and Future Purchase (“T&C”) (except where varied by an express agreement between the Parties which is recorded in writing and signed by an authorised representative of the Seller) shall constitute the entire contract between the Parties.

1.2. The Buyer accepts the T&C as binding at the time he places his order through the Platform.

2. THE PARTIES

2.1 The Seller. It is the company belonging to the Indie Campers group registered in the Country where the selected vehicle is (“Indie Campers”), and which operates through the Platform https://indiecampers.com (“Platform”)

2.2 The Buyer. For the purposes of these T&C, is the person who places an order through the Platform (hereinafter, the "Buyer")

2.3 The Parties. Indie Campers and the Buyer will be collectively referred to as the “ Parties” and, individually, each of them as the “Party”.

3. PARTIES NOTIFICATIONS

3.1 All notifications pursuant to this T&C shall be effective on their receipt date or, if after close of business, on the business day after

3.2 All notifications and communications between the Parties in connection with the T&C must be made in writing.

4. THE RESERVATION CONTRACT

The Order on the Platform

4.1. The Vehicle. The object of the T&C will be a used vehicle belonging to a predefined category listed in the Platform (hereinafter, the “Vehicle”).

4.2 By means of these T&C, the Buyer will search on the Seller listed fleet for one or several Vehicles which are available for sale in the Platform and which correspond to the characteristics that the Buyer desires.

4.3 If there is a Vehicle which matches the Buyer's wishes, the Seller will reserve the Vehicle through the Platform and the Buyer will be given a call option, that gives the right, not the obligation, to exercise the call and buy the Vehicle at a specified price within a specific time period through the signature of a Sales Contract , under the terms of these T&C.

5. The RESERVATION

5.1. At the time of the reservation of the Vehicle, the Buyer shall make a payment of € 999.00 (nine hundred and ninety-nine euros), or the equivalent amount in the country currency, on the Platform in order to confirm the reservation.

5.2. With the exemption provided for in the next paragraph, the amount referred to in the previous number shall be deducted from the Final Price.

5.3. The amount referred to in 5.1 will be refunded if at the time of selecting the Vehicle there are no Vehicles with the characteristics requested by the Buyer.

5.4. The amount referred to in 5.1 can be refunded at any time until the selection of the Vehicle and the signature of the Sales Contract.

5.5. After the signature of the Sales Contract, the amount referred to in 5.1 is not refunded if the Buyer gives up the purchase of the Vehicle, unless there is a proven mechanical issue or other reason stated in the T&Cs.

6. PROCEDURE

6.1. In the last quarter of each year, the Seller will notify the Buyer that the Vehicle with the characteristics selected and reserved is available for selection, confirmation of purchase and, after that, proceed to the signature of the Sales Contract.

6.2. The Buyer may select from the range of Vehicles provided in the Seller list, with specific chassis within the characteristics previously agreed between Buyer and Seller (hereinafter the “Selection Visit”), in the last quarter of the year, on a day, time and location stipulated by the Seller and agreed by the Buyer.

6.3. The Buyer will be provided with a list of Vehicles available where he can choose on a first-come, first-served basis. If the Buyer chooses a vehicle that has already been chosen the Seller will present the remaining vehicle options.

6.4. In the Selection Visit, if the Buyer does not select any specific Vehicle, he forfeits the reserve and the existing call option and is entitled to a full refund of the amount referred to in 5.1.

6.5. If on the day of pick up of the Vehicle chosen the Buyer does not take the Vehicle, the Buyer loses the right to the reimbursement referred to in 5.1, unless at that moment the Vehicle selected is not present.

6.6. For all due purposes, the Buyer acknowledges that the Vehicles are used, with all the periodic brand maintenance done and used in the rental business of the Seller.

7. PRICE and PAYMENT

7.1. The Vehicle purchase price includes VAT, if and as applicable, pursuant to the relevant tax laws and regulations (hereinafter the “Price”).

7.2. Starting on the day of pick-up of the Vehicle, the Buyer has a 14 days return policy where the Buyer is refunded for the full Price of the Vehicle paid, if he wishes to return the Vehicle

8. PAYMENT METHODS

8.1 At the time of placing the order in the Platform, the Buyer may pay by electronic payment via credit or debit card through the systems indicated, at all times, on the Platform. It might be required to perform a verification step with the card issuer during the Checkout process. It is also possible, depending on the country of purchase, to contract financing with the financial institution through the Platform to finance the Vehicle (see Clause 9 on financing).

8.2 Payments by credit or debit card are governed by the terms and conditions of the credit or debit card issuers. It is the Buyer responsibility to read the terms and conditions relating to these means of payment and ensure that they are understood and accepted.

8.3 Likewise, the Seller also accepts Payment by bank transfer through the payment platform available on the Platform.

9. FINANCING AGREEMENT

9.1 The Buyer can pay for the Vehicle with financing, through the Seller’s Financing Partner or any company in its group and its service providers related to the request and execution of the Vehicle financing process (hereinafter, the “ Financial Entity ”) .

9.2 If the Buyer decides to request financing for his Vehicle, the Buyer may do so at the appropriate time through the Seller’s website, which will redirect them to the website and/or digital platform of the Financial Entity (whose operations are independent of the Seller). The response that the Financial Entity gives on the Web is only representative, it is not contractually binding for the Financial Entity, for the Seller or for the Buyer. The Seller is not responsible for the processing, management or authorisation of the financing process of the Vehicle, being the exclusive responsibility of the Financial Entity.

9.3 The financing agreement will be subject to a separate contract between the Buyer and the Financial Entity. The Seller assumes no responsibility in this regard.

9.4 The provisions of this section, relating to the financing of the Vehicle by the Financial Entity, shall not affect any other provision of the T&C relating to a different matter

10. COLLECTION OF THE VEHICLE

10.1 The Collection of the Vehicle (hereinafter, the " Collection ") will be arranged with the Buyer on the day of Selection of the Vehicle and signature of the Sales Contract.

10.2. The Vehicle shall only be collected after the signature of all the necessary documentation for this purpose as well as after confirmation of the full payment of the Price.

10.3. If there is an agreement between the Parties, the collection of the Vehicle may be made at a later time than the one referred to in this clause 10.

10.4 In order for the Buyer to pick up the Vehicle, the Buyer needs to be accompanied by the proof of registration and the license plate plaques (a temporary registration is sufficient) plus proof of insurance.

11. WARRANTY

11.1. The Vehicle is covered by a warranty for the minimum period applicable by law in each of the Seller’s Country applicable legislation, that can be found under this link: https://eur-lex.europa.eu/legal-content/PT/NIM/?uri=CELEX:32019L0771 - in the specfic country tab.

11.2. The warranty will be provided by an entity appointed by Indie Campers

11.3 The Buyer will also benefit from the after-sale assistance for the period stipulated on the country legislation in adequate market conditions.

12 DEFECTS

12 .1 At the time of Collection the Seller will proceed with a full inspection and recondition of the Vehicle before collection.

12.2 When collecting the Vehicle, the Buyer declares to be aware of the Vehicle's current conservation status (without any structural or mechanical problem or flaw).

12.3 Although the Seller will check the vehicles beforehand; the Seller cannot be held responsible for any undetectable mechanical problems.

13. OWNERSHIP

13.1. The Parties agree that until all the necessary documentation is signed, as well as the delivery of proof of the effective full payment of the Price, the ownership of the Vehicle belongs to the Seller.

13.2. After the acts referred to in 13.1 have been performed, the Buyer can proceed with the registration of the Vehicle on his name. The Buyer needs to bring this proof of registration and licence plate in order to pick up the Vehicle.

13.3. Once ownership of the Vehicle passes to the Buyer the liability shall be borne by the Buyer.

14. 14º DAYS MONEY BACK GUARANTEE

14.1. The Seller grants to the Buyer a money-back guarantee ("14-Day Money-Back Guarantee") from the collection date of the Vehicle for a period up to 14 days after ("14-Day Money Back Guarantee Period").

14.2. During the 14-Day Money-Back Guarantee Period, the Buyer can request a cancellation of the order and return the Vehicle on the the location of pick up, provided that the Buyer has neither damaged the car nor driven more than 500 kilometres with it during the 14-Day Money-Back Guarantee period. If the Buyer damages the car or drives it more than 500 kilometres, the Seller can decide at its own discretion whether the 14-Day Money-Back Guarantee is still granted and, if necessary,the Seller can refuse to receive the Vehicle. In order to benefit from the 14-Day Money-Back Guarantee, the Buyer must communicate the decision to return the Vehicle in the 14 days period and agree on a delivery day that needs to be between the 14-Day Money Back Guarantee Period (“Delivery Appointment” (unless agreed by both Parties by written). In the Delivery Appointment the Vehicle will be checked for damages and the kilometres and the adjustments to the Price will be made.

14.3. If all the criteria are verified, the Seller will refund the purchase price, that is no longer refundable after the contract has been signed, as stated in the order, as soon as the Seller receives the Vehicle, and the car registration documents from the Buyer, together with all the documentation necessary to transfer the ownership of the Vehicle back to the Seller.

14.4. If the car has been driven more than 500 kilometres or damaged and the Seller still accepts the return of the car, the Seller will make the following deductions from the purchase price:

14.4.1. The actual depreciation due to the additional kilometres; and

14.4.2. The cost of repairing the damage caused to the car during the 14 day money back guarantee period.

14.5. If the Buyer will not be present on the Delivery Appointment to apply for the 14 day money back guarantee, the Seller assumes that the Vehicle will not be returned and the process is cancelled.

15 . MISCELLANEOUS PROVISIONS

15.1. If any Clause of this T&C is held to be illegal, invalid or enforceable, in whole or in part, such Clause shall apply with the elimination or modification that is necessary for it to be considered legal, valid and enforceable and to substantiate the economic and commercial intent of the Parties.

15.2. The non-exercise, or the late or partial exercise, of a right which is granted to either Party under this T&C shall not imply the waiver of that right nor prevent its subsequent exercise.

15.3. Any amendment or addition to this T&C shall only be valid if it is contained in a written document signed by all the Parties.

16. DATA PROTECTION

For the purposes of the regulations in force regarding the protection of personal data and services of the information society and electronic commerce, the personal data, both those provided for the formalisation of this contract and those collected during the term of the object of this T&C, will be incorporated according with the privacy policy present in the platform

17. GOVERNING LAW & JURISDICTION

17.1. This T&C and all its provisions shall be interpreted and construed in accordance with the Portuguese Law

17.2. Any dispute arising between the Parties about the interpretation or execution of the T&C shall be submitted to the competent Court.
